1. Information We Collect

The information we collect depends on how you interact with Wake Riderz. We collect information you choose to provide and certain technical information generated when you use our website and online services.

Information you provide directly

When you contact us, make or manage a reservation, or communicate with our team, we may collect information such as:

Waiver and passenger information

When a waiver is required, we may collect information needed to document the waiver and identify the person signing it. Depending on the circumstances, this may include a legal name, email address, phone number, date of birth, mailing address, signature, information identifying a parent or guardian or a minor passenger, and the IP address associated with the waiver submission.

We retain the IP address associated with a completed waiver as part of the waiver record to support record integrity, document the circumstances of the electronic submission, help prevent fraud or misuse, and maintain appropriate legal and business records.

Information collected automatically

When you visit or use our website, our web server and the companies that help us operate and secure the website may automatically receive technical information such as your IP address, browser type, device type, operating system, referring page, requested pages, date and time of requests, and security or diagnostic information.

We use this information for website operation, security, troubleshooting, fraud and abuse prevention, and understanding how our online services are functioning.

We do not use personal information for purposes that are materially different from those described in this policy without providing any notice or choice required by applicable law.

3. Payments

Payment transactions made through our online services may be handled by third-party payment processors. For applicable online card payments, Wake Riderz uses Stripe to process the transaction. Stripe may collect and process payment information in accordance with its own privacy practices. You can review the Stripe Privacy Policy.

Wake Riderz does not store your complete payment card number or card security code on our web server. Payment information is processed by the applicable payment processor using its own systems and security practices.

We may retain transaction details that do not include your full payment card credentials, such as the amount paid, payment status, transaction or processor reference, reservation information, and related accounting records.

For example, our current online systems may use providers such as Stripe for payment processing, Postmark for transactional email delivery, and Cloudflare for website security and network services.

We may also disclose information when reasonably necessary to comply with applicable law, a valid legal process, or a lawful government request; to investigate suspected fraud or unlawful activity; to protect the safety or rights of Wake Riderz, customers, passengers, captains, or others; or to establish, exercise, or defend legal claims.

If Wake Riderz or Barco Kings LLC is involved in a merger, acquisition, financing, reorganization, sale of assets, or similar business transaction, information may be transferred as part of that transaction subject to applicable law.

We do not sell customer contact lists or contact-form, booking, or waiver information, including waiver IP address information, to data brokers for money.

5. Cookies & Technical Data

Our website and the service providers that help us operate and protect it may use cookies or similar technologies when needed for website functionality, security, fraud prevention, session management, or other operational purposes.

Your browser may allow you to block or delete cookies. Blocking certain cookies may affect the operation of website features or third-party services.

Some pages may also contain links to or embedded content from third-party websites or services. When you interact with those services, the third party may process information according to its own privacy practices.

6. Data Retention

We retain personal information for as long as reasonably necessary for the purposes described in this policy. The appropriate retention period depends on the type of information, why it was collected, and applicable operational, legal, accounting, tax, insurance, dispute-resolution, and recordkeeping requirements.

When information is no longer reasonably needed, we may delete, anonymize, or securely archive it as appropriate. Information contained in backups or records that must be preserved may remain for a longer period until it can be deleted in the ordinary course or the applicable retention requirement expires.

7. Information Security

We use reasonable administrative, technical, and organizational measures intended to protect personal information against unauthorized access, use, alteration, or disclosure.

No website, network, electronic transmission, or storage system can be guaranteed to be completely secure. You should use reasonable care when sending personal information online and should not submit payment card information or other unnecessary sensitive information through our general contact form.

Wake Riderz provides boating experiences that may include minor passengers, but our website and online booking services are intended to be used and managed by adults.

A parent or legal guardian may provide information about a minor when reasonably necessary for a reservation, waiver, safety requirement, or participation in a Wake Riderz activity.

Our general website is not directed to children under 13, and we do not knowingly ask children under 13 to submit personal information directly through our general website forms. If you believe a child under 13 has provided personal information to us directly without appropriate parental or guardian involvement, please contact us so we can review the situation and take appropriate action.

  • Ask whether we process personal information about you
  • Request access to certain personal information
  • Request correction of inaccurate information
  • Request deletion of certain information
  • Request a portable copy of certain information
  • Opt out of certain processing when applicable law provides that right
  • Exercise applicable privacy rights without unlawful discrimination or retaliation

These rights are subject to applicable law and may have exceptions. For example, we may need to retain certain information to complete a transaction, maintain legally required records, prevent fraud, resolve disputes, protect legal rights, or comply with another legal obligation.

How to submit a privacy request

You may submit a privacy request by emailing [email protected] or by using our contact form.

Please describe the request and provide enough information for us to reasonably identify the relevant records. We may need to verify your identity before completing certain requests and will use information submitted for verification only as reasonably necessary to process the request.

Where applicable law permits an authorized agent to submit a request for you, we may request information reasonably necessary to verify the agent’s authority.

Appeals

If applicable law gives you the right to appeal a decision we make regarding a privacy request, you may submit an appeal by replying to our decision or emailing [email protected] with “Privacy Appeal” in the subject line.

Our website may link to third-party websites, booking platforms, maps, payment services, video providers, social-media services, or other external services that Wake Riderz does not control.

This Privacy Policy does not govern the independent privacy practices of those third parties. We encourage you to review the privacy information provided by a third-party service when you choose to interact with it.
